Skivvy Serve Private Limited (hereinafter referred to as “Housmaid” or “Us”), primarily operates, controls and manages the Services (through Service Providers such as Maid, Cook, Babysitter, Gardner, Servant, Driver, Elder Care and Pantry Boy, etc. hereinafter referred to as “Team Member”) provided by it through its website www.housmaid.com operated from its corporate office at Unit No. 152, Spaze IT Park, 1st Floor, Sohna Road, Sector 49, Gurugram, Haryana – 122001 (“Gurgaon Corporate Office”). The Terms and Conditions mentioned hereinafter are applicable to all individuals who use the website or intend to use the website www.housmaid.com or avail the services provided by Housmaid (hereinafter also referred to as “User or “You”).

Please read this page carefully. If you do not accept the terms of use stated herein, do not use the web site and its services. In addition to the terms mentioned herein, the User is also governed by the Privacy Policy at https://housmaid.com/in/privacy-policy/

That Housmaid is a full-stack platform for hiring Maid, Cook, Babysitter, Gardner, Servant, Driver, Elder Care, and Pantry Boy, etc as per Client’s budget and requirements. We attempt to make the flow of process easy in order to meet your requirements and assist you with the same.

By using/accessing the website – www.housmaid.com, you are indicating that you accept the terms of user and your acceptance is bound by the provisions of these terms of use, including any updating/revisions made therein. Skivvy Serve Private Limited (“Company”) may revise these terms of use, including Housmaid privacy statement at its discretion. The company does not have any obligation or responsibility to inform or intimate you in any manner, directly or indirectly, of the posting once updated or prior to such updation. Your use of the website (defined below) following any such modification constitutes your agreement to follow and be bound by the terms of use as modified.

Any additional terms and conditions, disclaimers, privacy policies and other policies applicable to general and specific areas of this web site or to particular content are also considered as terms of use. You should visit this page periodically to review the terms of use, because they are binding on you. The terms “you” and “user” as used herein refer to all individuals and/or entities accessing the website for any reason.

You acknowledge that the Website serves as a venue for the online booking of Maid, Cook, Gardner, Servant, Babysitter, Eldercare and Pantry Boy. By clicking on “I have read and agree to the terms of use,” you have the authority to enter into these Terms of Use. You authorize the transfer of payment for Services requested through the use of the Website, and you agree to be bound by all terms and conditions of these Terms of Use and any other documents incorporated by reference herein. If you do not agree to the foregoing, you should not click to affirm your acceptance thereof, in which case you are prohibited from accessing or using the Website. If you do not agree to any of the provisions set forth in the Terms of Use, kindly discontinue viewing or participating in this Website immediately.

That Housmaid is an ethical and law-abiding entity committed to the service of providing its Clients with Team Members appropriate for prescribed jobs and with providing Team Members a safe, secure and appropriate working environment. Housmaid has a no-tolerance policy against any individual committing crimes or violating the law, whether a Team Member or a Client. Housmaid shall take strict actions against the Client in the event that Housmaid suspects, receives information or is informed of any action, inaction or intention of the Client to commit illegal or unlawful activities against the Team Member.

You specifically agree that by using the website, you are at least 18 years of age and you are competent under law to enter into a legally binding and enforceable contract.

  1. While every endeavour is made by Housmaid to introduce satisfactory candidates to the client, it is the responsibility of the client to satisfy themselves of the suitability of an applicant before hiring them. If required the client may arrange medical examinations or background check, reference check, etc. of the candidate prior to hiring them. Housmaid will assist and help wherever possible to facilitate the process.
  2. We will be following a KYC procedure to collect relevant information and documentation on each Team Member. Housmaid shall get the Aadhar verification check (using online medium) done for the Team Member, to ensure that the identity and details provided by the Team Member are legitimate.
  3. As per the Haryana govt rules/law, Housmaid shall apply for the police verification of all the Team Members within one week from the date of deployment. Also, all the cost of verification will be borne by Housmaid only. Post applying for police verification, Housmaid will share the verification report with the Client within 15 days (approximately) from the date of deployment of the Team Member. As a process of verification, in some cases, Housmaid also checks reference status along with their current address verification.
  4. That Housmaid will not take any responsibility in the event that any issues or concerns arise with respect to the Team Member before or during the verification process. Housemaid shall apply for police verification only when the Team Member is confirmed by the Client.
  5. That Housmaid is taking all possible steps, as per law, in terms of verification of Team Member. Further in case of any direct or indirect damage or any related situation Client and Team Member can deal directly taking all available actions and legal recourses without involving Housmaid. Housmaid will not be liable for any activities or inactivities of the Team Member upon deployment at the residence of the Client or during the course of Employment.
  6. Housmaid allows 2 paid leaves each month to all our Team Member. All our Team Members are entitled to avail 2 leaves in a month without any salary deduction. In case any Team Member has not availed any leave in any particular month those leaves can be accumulated and carried forwarded to the next month. This policy reduces absenteeism and also help Team Member to take leave only once after a few months of time.
  7. In case the Team Member has unavailed leave balance, the Client has to pay the total amount equivalent to the leave balance accumulated, to the Company immediately when the Team Member is released by the Client and the payment of the balance shall be made within 2 weeks from the date of release.
  8. We provide a 2-day trial to you with our Team Member assigned to you before we seek the payment of one time registration charge;
  9. Monthly fee for the services of the Team Member are to be paid by the last week of every month;
  10. Prior to the placement of the Team Member, You have to give us the ‘job description’ of the type of work the Team Member needs to do and the salary offered. You cannot make the Team Member do anything outside the job description nor reduce the salary of the Team Member, that is agreed upon. If the Team Member leaves because you asked/made them do anything outside the job description or due to reduction of salary or due to any misbehaviour at your end, Housmaid will not replace the Team Member and neither refund the amount paid by you.
  11. We will provide replacement of Team Member with a maximum of 3 replacements when reasonable and true grounds are given for the same; replacement in situations where the Team Member is alleging harassment, ill-treatment, being overworked will not be made, and if made at all will be at the sole discretion of Housmaid
  12. We will need appropriate time to find and allocate suitable resources as a Team Member in your premises. Since each requirement is different from the last one, it is difficult to have Team Members available at every point in time, hence, we will need an adequate amount of time once the query is raised with appropriate details. We will attempt to communicate the expected Turn-Around-Time in providing you with a Team Member once we have received the requirements.
  13. We understand that each Team Member you hire is going to be as per your expectation and requirements and we will make our best attempt to provide you appropriate Team Members; in case We are unable to provide you Team Members as per your expectations we will provide you replacements upon your request, when provided reasonable issues from your end as mentioned and specified above;
  14. You undertake under all circumstances, to notify Housmaid immediately upon agreeing to hire a Team Member introduced by us;
  15. An invoice will be sent to you in between 20th-24th of every month which is payable immediately or within 5 days of time.
  16. We attempt to provide skilled and trained Team Members matching your requirements. However, some type of Team Members might be unavailable at some point when a request is made and You might have to wait for a Team Member to be assigned to you for longer than expected. We expect you to cooperate with us in such situations.
  17. That we provide you Team Members upon request and for the payment as is due and we do not collect any brokerage/commission/additional fee apart from one time registration charge to cover the cost of verification, deployment, KYC etc.
  18. We expect you to provide a conducive, safe and comfortable working environment to the Team Member and inform you that it is your liability to keep the Team Member safe and protected.
  19. In case you do not like the Team Member who has been assigned to you, kindly give us a notice of 15 days before you release the Team Member so that we can find a better quality Team Member for you. In case no notice is given to us before releasing of the Team Member, we will require sufficient time to replace the Team Member as per availability and requirement and shall communicate the same to you. The Team Member which has been sent for replacement cannot be offered less salary than the first Team Member. The job description or work required to do by the replacement Team Member cannot be changed by You. In case you wish to release the Team Member or the Team Member leaves the job and you wish to take a replacement, you need to clear the salary dues of the previous Team Member before a replacement is sent. In case the salary of the previous Team Member is not cleared, we will not be sending a replacement and shall not be liable for the same.
  20. In case the Team Member is absent because they are unwell/due to a family emergency, no replacement will be given if the Team Member promises to join back as soon he/she is healthy/fit for work. In case the Team Member does not join back within 10 days, you can ask us for a replacement within a reasonable time.
  21. Since the salary expectation of a Team Member keep changing for a particular job, it might not be possible to find a Team Member in the same salary as your previous Team Member in case of replacement. We will try it level best to try and find a new Team Member in same salary, however request you to consider an increased salary if the Team Member of requisite qualifications is seeking the same.
  22. If the invoices are settled and due to any reason the Team Member resigns then a free replacement will be provided as mentioned above, till a maximum of 3 replacements have been provided in the same year. Usually the time taken for the replacement is 15 days but it may vary depending on the availability. In case of an unlikely event of we not able to give you a replacement within 15 days of being intimidated by the requirement of replacement and you want to cancel the contract, a credit note will be issued for the entire amount that you paid to us which you can use for any Housemaid services in the future.
  23. It is your responsibility to check the bags, purse or any other thing that the Team Member is carrying before the Team Member enters the home and before the Team Member leaves the home. It is also your responsibility to be careful regarding your belongings and be prudent with safety and security of the same.
  24. The client agrees that the Team Member will be not be tortured, harassed, harmed mentally or physically, in any manner whatsoever. Also you cannot increase the work or reduce the salary of the Team Member other than what was discussed during the interview.
  25. If you make the Team Member act in an illegal, unlawful or violative manner, you alone will be responsible for such activity; Housmaid shall take no responsibility;
  26. All payments have to be made in favour of ‘Skivvy Serve Private Limited’ as and when due;
  27. In case you wish to get a replacement and we are unable to find any suitable candidate for you (within 3 attempts) we will be ready to provide refunds, at the sole discretion of the Company.
  28. We do a KYC and thorough check of the Team Member being assigned to you. However, it is difficult to gauge a human being’s ethical radar and control their morality. In case the Team Member acts in a way that is beyond our scope or authority, Housmaid shall not be held responsible for the same.
  29. Salary of the Team Member starts from the day Team Member get on boarded to house/office at any location. Monthly amount can be paid through various payment methods including bank transfer, Credit card, Debit Card, Internet Banking. You have to pay the amount of registration charge once the trial period of 2 days is over and the monthly fee before the end of every month.
  30. Amount conveyed by the Housmaid team is all inclusive of taxes, as well as the service fee, that amount will be treated as the finalised monthly amount. You do not need to pay any extra fee apart from the monthly rental. No hidden or extra charges.
  31. One time registration charge is a one time fee collected from you to get you as a registered Client of Housmaid, post the payment of registration charge you can avail any service provided by Housmaid without paying any one time fee for a period of 2 years from the date of payment. This registration charge is to be paid in advance just after completing the trial period.
  32. GST rate of 5% is already included and specified in the monthly invoice, GST amount is directly to be paid to the tax department, Govt. Of India. Also as per the rule specified in case of 5% GST, no tax credit input can be availed by the Clients and the same will be specified in the invoice too.
  33. Housmaid monthly service fee varies from 5% to 30% depending upon the service requirement, quality and various other parameters. Service fee is always included in the monthly fee charged from you.
  34. Invoice contains salary of the team member, Housmaid service fee and the GST.
  35. An invoice will be sent to You via registered email on 20th-24th of every month. Any payment received is non-refundable. Raised invoices should be settled within 5 days from the date of invoice raised. Monthly charges need to be paid before the end of every month.
  36. Any online payment method will lead to extra charge of around 2% (convenience fee)
  37. We take care of all the charges incurred while verification of Team Member, selection of Team Member, any certification involved, any health insurance, providing dress and providing training.
  38. Client should note that the One time registration charges paid by the Clients is to cover the verification, trial, training, and deployment of the Team Members. It is valid up to the period of 2 years and is not refundable and non-negotiable.
  39. Maximum of up to 3 replacements in a year can be availed free of cost from Housmaid. However, in case of unsatisfactory services, post internal verification replacements can go up to 5-6 as and whenever requested by the Client, on the sole discretion of the Company.
  40. Trial period is only free in case Clients rejects the deployed Team Member and the Client is not satisfied with the services. However, if the Client agrees to accept the Team Member’s services then we have no reason to deduct Team Member’s salary for the trial period, hence if Client confirms and agree to continue with the same Team Member after the trial period, the Client needs to pay the amount for the trial period also.
  41. In the event that the Client comes to know of any information or detail about the Team Member which the Client knows or suspects has been hidden from Housmaid or the Client initially, the Client shall intimate Housmaid of the same immediately. In the event that the Client fails to do so, the Client shall be held responsible for any activities or inactivities that may arise from such instances.
  42. That in the event that there is a delay in payment by the Client or the Client is avoiding to make payment of the monthly fee for the services availed they shall be liable for legal action.
  43. It is not possible to check the intention of any Team Member deployed by Housmaid, therefore in case of any direct or indirect damage caused by the Team Member will be the sole responsibility of the Client only.
  44. All the Clients are requested to keep the Team Members happy and safe, also it is advisable to maintain a healthy relationship with Team Members. It helps to reduce the absenteeism along with keeping long term employment.
  45. In the case of full-time Team Members, Clients are requested to provide food as well as proper accommodation facilities to the Team Members..
  46. It is the responsibility of the Client to keep the Team Member medically fit and fine and provide assistance or help for any urgent medical situations.
  47. In case the Client hires the Team Member directly which is introduced by team Housmaid, Housmaid team has the right to recover the damage fee which is equivalent to 2 months salary of the Team Member.
  48. Any kind of advance or gift offered by the Client to the Team Member without informing Housmaid will be the sole responsibility of the Client..

TERMINATION BY YOU

You may cancel your use of the Website and/or terminate the Terms of Use with or without cause at any time by following the link in your Account under “Account Preferences” to “Deactivate Account.” We will consider your cancellation of the account in case you choose to deactivate your account as termination of your account.

EFFECT OF TERMINATION

Upon termination of your Account, your right to participate in the Website, including, but not limited to, your right to offer or purchase Services and your right to receive any fees or compensation, including, without limitation, referral discounts, incentive bonuses, or other special offer rewards, shall automatically terminate.

You acknowledge and agree that your right to receive any Services is conditional upon your proper use of the Website, your adherence to the Terms of Use, the continuous activation of your Account, and your permitted participation in the Website. In the event of Termination of Service, your Account will be disabled and you may not be granted access to your Account or any files or other data contained in your Account. Notwithstanding the foregoing, residual data may remain in the Housmaid system. Unless Housmaid has previously cancelled or terminated your use of the Website (in which case subsequent notice by Housmaid shall not be required), if you provided a valid email address during registration, Housmaid will notify you via email of any such termination or cancellation, which shall be effective immediately upon Housmaid ‘s delivery of such notice.

Upon Termination of Service, the following shall occur: all rights granted to you hereunder will immediately terminate; and you shall promptly destroy all copies of Housmaid Data (as defined below), details of the Team Member and other content in your possession or control. You further acknowledge and agree that Housmaid shall not be liable to you or any third party for any termination of your access to the Website. Upon Termination of Service, Housmaid retains the right to use any data collected from your use of the Website for internal analysis and archival purposes, and all related licenses you have granted Housmaid hereunder shall remain in effect for the foregoing purpose. In no event is Housmaid obligated to return any Submitted Content to you. Sections of this document shall survive expiration or termination of the Website or your Account.

You agree to indemnify and hold Housmaid, and its officers, managers, members, affiliates, successors, assigns, directors, agents, service professionals, suppliers, and employees harmless from any claim or demand, including reasonable attorneys’ fees and court costs, made by any third party due to or arising out of the Termination of Service.

Refund Policy:

Monthly billing/fee cannot be waived off or refunded after availing the services. If any of the Team Member leaves the job in between his/her work tenure the amount will be charged on a pro rata basis. If at any point of time you want to discontinue any services, the amount will not be refunded back. We are not responsible for the claim of any damage/loss, liabilities, expenses incurred by the Team Member.

Replacement Policy:

Upto 3 Free Replacements of any Team Member is valid. Team Member are allowed to avail 2 paid leaves in one-month period.

Dispute resolution:

If a dispute arises between you and Housmaid, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and Housmaid hereby agree that we will resolve any claim or controversy at law and equity that arises out of the Terms of Use. Before resorting to the filing of a formal lawsuit or complaint, we strongly encourage you to first contact us directly to seek a resolution via email at support@housmaid.com. Please lodge formal complaints on this email address and we will take requisite steps to resolve the issue at hand. The dispute shall be resolved through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

Governing Law:

The Terms of Use shall be governed in all respects by the laws of India and any legal proceeding arising out of this Agreement will occur exclusively in the courts located in New Delhi, India.

Advertisment:

Aspects of the Website and other Housmaid services may be supported by advertising revenue. As such, Housmaid may display advertisements and promotions on the service of third Party entities. The manner, mode and extent of advertising by Housmaid on the Website are subject to change and the appearance of advertisements on the Website does not necessarily imply endorsement by Housmaid of any advertised products or services. You agree that Housmaid shall not be responsible or liable for any loss or damage of any sort incurred by you as a result of any such dealings or as the result of the presence of such advertisers on the Website.

The Website may provide, or third parties may provide, links, contact forms and/or phone numbers to other websites or resources, including, without limitation, social networking, blogging and similar websites through which you are able to log into the Website using your existing account and log-in credentials for such third-party websites. Limitations of Liability:

You hereby acknowledge and agree that Housmaid shall not be liable for submitted content or the defamatory, offensive, or illegal conduct of any third party or service user or service provider and that the risk of harm or damage from the foregoing rests entirely with you. you further acknowledge and agree that Housmaid shall not be liable for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantage) whatsoever resulting from or relating to any contract between website users entered into independently of the website.

FORCE MAJEURE

Neither Housmaid nor you shall be liable to the other for any delay or failure in performance under the Terms of Use, other than payment obligations, arising out of a cause beyond its control and without its fault or negligence. Such causes may include, but are not limited to fires, floods, earthquakes, strikes, unavailability of necessary utilities, blackouts, acts of God, acts of declared or undeclared war, acts of regulatory agencies, or national disasters.

INDEMNIFICATION & RELEASE

You agree to defend, indemnify and hold harmless Housmaid, and its officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, service professionals, suppliers, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from your use of, access to, and participation in the website; your violation of any provision of the terms of use, including the privacy policy; your violation of any third-party right, including without limitation any copyright, property, proprietary, intellectual property, or privacy right; or any claim that your submitted content caused damage to a third party. this defence and indemnification obligation will survive these terms of service and your use of the website.

If you have a dispute with one or more website users, you forever release Housmaid (and its officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, service professionals, suppliers, agents, subsidiaries, and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with your use of the website and/or any submitted content.

The terms of use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Housmaid without restriction.

NO THIRD – PARTY BENEFICIARIES
